    The comprehensive 37-page document alleges that DraftKings eliminated merely a portion of references to the protected terminology following the NCAA’s initial request. According to the filing, ongoing usage inflicts “irreparable harm” upon the organization’s brand reputation.

    The athletic association now pursues an emergency restraining order. The requested injunction should take effect prior to next Thursday’s Sweet 16 tip-offs.

    Additionally, the NCAA demands monetary restitution. This encompasses legal fees alongside either three times the sustained damages or triple the revenue DraftKings generated through the purported trademark violations.

    Betting Platform Counters With Fair Use Defense

    DraftKings issued a rebuttal to the litigation through a Saturday morning statement. The operator maintains its “March Madness” usage complies with fair use principles.

    According to a company representative, the terminology appears in standard text format solely for tournament identification purposes, not as trademark branding. The platform draws parallels to its display of other competition names such as the NIT on the application.

    DraftKings further characterizes the usage as constitutionally protected expression under First Amendment provisions. Company officials express confidence that judicial review will reject the NCAA’s injunction petition.

    As of Saturday morning, DraftKings continued displaying “March Madness” as a navigation category on its application’s main interface. The platform wasn’t operating in isolation.

    BetMGM similarly featured the NCAA’s protected terminology on its system. FanDuel had employed “March Madness” on Friday before revising the designation to “NCAAB” by the following day.

    The NCAA has historically maintained deliberate separation between its brand identity and the gambling sector. More than ten years ago, it aligned with the four primary U.S. professional sports organizations to challenge New Jersey’s sports betting legalization initiatives.

    College Sports Body Remains Isolated From Industry Partnerships

    The Supreme Court ultimately sided with New Jersey’s position. Following that decision, 40 states have proceeded to authorize regulated sports wagering.

    The NBA, NFL, NHL, and MLB all reversed their stances after the landmark ruling. These leagues have each established collaborative relationships with DraftKings and additional authorized betting operators.

    The NCAA has declined to pursue similar arrangements. The organization has consistently rejected partnership opportunities with any sportsbook entity.

    Alternatively, the association has urged state governments to prohibit specific wager categories on collegiate competitions. This includes individual player proposition bets, which the NCAA identifies as compromising athlete welfare.

    The NCAA did renew its arrangement with Genius Sports this past April. The agreement designates Genius Sports as the sole postseason statistical provider to betting platforms through 2032.

    The Genius Sports contract encompasses both men’s and women’s basketball championship events. It additionally permits usage of NCAA branding and insignia.

    The yearly championship tournament ranks among the nation’s most significant betting occasions. The American Gaming Association projected that Americans would place over $3 billion in wagers on this year’s tournaments via legitimate sportsbooks.

    The NCAA’s legal filing highlighted DraftKings’ “March Mania” elimination contest as one illustration of a “confusingly similar variation” of its protected intellectual property. March Mania and March Madness share identical initial words, and both terms carry comparable meanings.

    An inquiry directed to an NCAA representative remained unanswered as of Saturday.
